** DF-02: Government Response to Counterfeits: Contracting (Advanced)
Class Overview
In November 2011, the Senate Armed Services Committee held an oversight hearing about counterfeit electronic parts entering the military supply chains. One of the results of the hearing was the amendment of the Fiscal Year 2012 National Defense Authorization Act (NDAA). The amendment commonly referred to as “Section 818,  Detection and Avoidance of Counterfeit Electronic Parts, requires the Department of Defense to issue or revise guidance for purchasing electronic parts, the definition of terms specific to counterfeit electronic parts, and reporting of counterfeit electronic parts.

Since the hearing several Defense Federal Acquisition Regulation Supplement (DFARS) and Federal Acquisition Regulations (FAR) have been written to address the requirements under Section 818.

The UK government wrote a government standard to address the prevention of counterfeit materiel from entering the Ministry of Defence supply chain. The UK is currently developing clauses to implement the MOD DEF-STAN 05-135.

The class will cover:

  • Review of government contracting.
  • Brief review of how Section 818 came about.
  • What are the relevant FAR and DFAR clauses regarding counterfeits being developed under Section 818?
  • What do the FAR and DFAR clauses require?
  • Where can I find the latest status of DFAR and FAR clauses regarding counterfeits or any other government contracting clauses?
  • What are the UK government contracting clauses for implementing the MOD DEF STAN 05-135?
NOTE: This class discusses in detail the requirements of the specific DFARS and FAR clauses. If you do not have a general understanding of this subject, it is recommended that you take InterCEPT Training DF-01: Government Response to Counterfeits: Contracting (An Overview).
