Clarifications and Additions to United States Trade Representative Section 301 China Tariffs

As a response to China’s “unfair” trade practices related to the transfer of American intellectual property and technology, a 25% tariff went into effect on July 6, 2018. The tariff covers 818 product types, as defined by their corresponding Harmonized Tariff Schedule (“HTS”) codes, manufactured in China and imported into the United States. This article aims to clarify how the tariff is assessed and applied by US Customs and Border Patrol (CBP) and provides sample scenarios and additional information in a question and answer format.
